Legal update: Statutory Sick Pay and ‘Test and Trace’

On the 28th of May the government announced the extension of Statutory Sick Pay (SSP) to those who have been told to self-isolate under the ‘Test and Trace’ system.

The system which is operated and managed by the National Health Service (NHS) launches today in England (see here).

Accordingly, a person who has been notified of their having come into contact with another person who has tested positive for Coronavirus and who is self-isolating for 14 days as a result, will be entitled to SSP.

The legislation enshrining this right to SSP can be found inThe Statutory Sick Pay (General) (Coronavirus Amendment) (No. 4) Regulations 2020 (see here)

If you are unsure on the eligibility criteria for SSP please consult our SSP brief which can be found here.
